Terms of Use

This is a legal agreement ("Agreement") between you ("User," "you," "your") and Journeyfront, Inc., a Delaware corporation ("Journeyfront," "we," "us," or "our"). By accessing the Journeyfront website, currently located at www.journeyfront.com (the "Site"), and using any of the Journeyfront services, software, and platform accessible through the Site or offered in conjunction with the Site (collectively, the "Services"), you agree to and are bound by the terms and conditions of this Agreement. The section titles in this Agreement are for convenience only and have no legal or contractual effect.

By continuing to use the Site or the Services, you acknowledge and accept these terms. If you do not agree, please discontinue use of the Site and Services immediately. 

This Agreement is subject to change by Journeyfront in its sole discretion at any time. Any such changes will be posted on the Site, and your continued use of the Site or the Services after the posting of revisions will constitute your acceptance of such revisions.

1. Definitions

  • "Individual User": A User accessing the Services for their own personal career exploration and assessment.
  • "Client": A business entity that has registered to use the Services for hiring and talent management purposes.
  • "Authorized User": An employee, agent, or contractor of a Client who is authorized to access the Client's account.
  • "Candidate": An individual who applies for a job opportunity with a Client through the Services.
  • "Content": Any information, data, text, video, audio, or other materials submitted to, or created in, the Services by a User.

2. Eligibility and Use of Services

  • Eligibility: To be eligible to use the Site and Journeyfront Services, you represent and warrant that (i) you are at least 18 years old at the time you use the Site or register to the Journeyfront Services; (ii) the information you provide through the Site or the Journeyfront Services is accurate; and (iii) your registration to and use of the Site and/or Journeyfront Services does not violate any applicable law, regulation, or legal obligation to a third party.
  • Use by an Individual User: If you are joining the Site for your own personal benefit, you may complete self-assessments to build a profile. Based on your responses, Journeyfront may suggest careers or companies that could be a good fit for you. Subject to your communication preferences, you may be contacted by recruiters or other personnel from organizations hiring. If you are joining the Site at the request of your Employer or a potential Client of Journeyfront’s (an employer), please note that by continuing you are granting the Client access to the information you choose to provide.  
  • Use by a Client: If you are a business entity, you may use the Services for your internal business purposes related to recruiting, screening, interviewing, and hiring Candidates. You are responsible for all activity that occurs under your account, including the actions of your Authorized Users.
  • Account Security: You are responsible for maintaining the confidentiality of your account login information and are fully responsible for all activities that occur under your account. You agree to immediately notify Journeyfront of any unauthorized use or breach of security.
  • Risk Assumption: You assume all risk when using the Services, including but not limited to all risks associated with any online or offline interactions with others. You agree to take all necessary precautions when communicating with other Users.
  • Social Media: We may provide the option to connect your Journeyfront account to an account on a social networking site (e.g., LinkedIn). By enabling this feature, you consent to the release of information about you to Journeyfront in accordance with the permissions you set on the third-party site.

3. Acceptable Use and Conduct

As a User of the Site and Services, you agree to the following:
  • No False Information: You will not provide inaccurate, misleading, or false information to Journeyfront or to any other User.
  • No Harassment: You will not harass, annoy, intimidate, or threaten any other Users or any Journeyfront employees or agents.
  • No Unauthorized Commercial Use: You will not advertise or solicit any User to buy or sell products or services through the Site, nor will you transmit any chain letters, junk mail, or spam. This includes, but is not limited to using the site for activities:
    • That require any form of payment to apply;
    • That require the recruitment of others to apply;
    • That are unlawful, discriminatory, misleading, fraudulent, or inconsistent with applicable employment, privacy, or advertising laws.
    • That request the donation or use of human body parts (including egg donation and surrogacy services);
    • That are not considered bona fide employment or consultancy in an applicable jurisdiction;
    • That are not compliant with or request information that is not compliant with, or is in violation of, the laws and regulations of any applicable jurisdiction;
    • For multi-level marketing, pyramid schemes, franchising, or any similar type of arrangement;
    • That make citizenship or permanent residency a condition of employment if not required by applicable law;
    • That violate the terms of this Agreement in letter or spirit.
    • That collect or solicits personal information about anyone under 18; 
    • Is used for or in connection with spamming, spimming, phishing, trolling, or similar activities.
  • Prohibited Content and Activities: You will not post, transmit, or engage in any activity that: promotes racism, bigotry, or harm; is defamatory, obscene, or abusive; infringes on a third party's copyrighted content or trademarks; promotes illegal activities; contains viruses or other harmful code; or uses scripts, bots, or other automated technology to access the Services.
  • Job Posting Restrictions (for Clients): Clients agree not to post jobs that are not bona fide employment opportunities; require payment to apply; are for multi-level marketing or pyramid schemes; or otherwise violate applicable employment laws and regulations.

4. Proprietary Rights and License to Content

  • Journeyfront's Proprietary Rights: You acknowledge that Journeyfront owns all rights, titles, and interests in and to the Services and the Site. This includes our predictive models, assessment methodologies, AI scoring algorithms, software, and all other proprietary information and technology. You agree not to copy, modify, or reproduce any of our proprietary information without our prior written consent.
  • License to Your Content: By posting Content to any part of the Services, you automatically grant Journeyfront an irrevocable, perpetual, non-exclusive, fully-paid, worldwide license to use, reproduce, display, and distribute such Content, and to prepare derivative works of, or incorporate into other works, such Content, for the purpose of providing and improving the Services. From time to time, we may create, test or implement new features or programs on the Site in which you may voluntarily choose to participate or may be a part of a test group with special access, in accordance with the additional terms and conditions of such features or programs. By your participation in such features or programs, you grant us the rights stated in this subsection in connection with the additional terms and conditions (if any) of such features or programs.

5. User Information and Privacy

  • Privacy Statement: For information about the collection and use of information provided by you, please refer to Journeyfront’s Privacy Statement, currently located at https://www.journeyfront.com/privacy  
  • Disclosure by Law: You acknowledge and agree that Journeyfront may disclose information you provide if required to do so by law, or if we believe in good faith that such disclosure is reasonably necessary to: (1) comply with legal process; (2) enforce this Agreement; or (3) protect the rights, property, or personal safety of Journeyfront, its Users, or the public.

6. Artificial Intelligence and Automated Processing

You acknowledge that the Services may utilize artificial intelligence (AI) and machine learning models for certain features.

  • AI Scoring: The Services can automatically score Candidate responses to video, audio, and text-based screening questions based on criteria you provide.
  • Predictive Models: The Services offer predictive behavioral assessments designed to forecast a Candidate's potential job performance and retention. These models are refined through a "closed-loop optimization" process that analyzes post-hire performance data to improve accuracy over time.
  • User Control and Oversight: AI-generated scores are intended to support, not replace, human decision-making. AI scores are clearly identified, and Users retain full control to manually override any AI-generated score at any time. Users are ultimately responsible for all hiring decisions.
  • No Liability Clause: Journeyfront is not responsible for hiring decisions made by Clients. By using the Journeyfront Services, Users consent to processing, and Clients retain sole responsibility for compliance with applicable consent, employment and anti-discrimination laws. 

7. Third-Party Integrations

The Services may integrate with third-party applications ("Third-Party Services") to provide certain features, such as interview scheduling, e-signatures, and certain advanced third-party assessments. We are not responsible for the content or data practices of these Third-Party Services.

The Journeyfront Services may contain links to web sites of third-parties, including without limitation, advertisers, which are not under the control of Journeyfront, and Journeyfront is not responsible for the content of any linked site or any link contained in a linked site, or any changes or updates to such web sites. Journeyfront provides these links to you only as a convenience, and the inclusion of any link does not imply that Journeyfront endorses or accepts any responsibility for the content on such third-party web sites. Your correspondence or business dealings with, or participation in promotions of, job-related advertisers found on or through the Journeyfront Services (including payment and delivery of related goods or services, any personal information or opt-in contact information voluntarily given to advertisers, and any other terms, conditions, warranties or representations associated with such dealings) are solely between you and such advertiser. You agree that Journeyfront will not be responsible or liable for any loss or damage of any sort incurred as the result of any such dealings, including the sharing of the information you supply to Journeyfront with job advertisers, or as the result of the presence of such advertisers on the Services. 8. Disclaimer of Warranty

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." JOURNEYFRONT EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. JOURNEYFRONT MAKES NO WARRANTY THAT THE SERVICES, INCLUDING ANY SCORES OR PREDICTIONS, WILL BE ACCURATE, RELIABLE, OR ERROR-FREE, OR THAT THE SERVICES WILL MEET YOUR REQUIREMENTS.

9. Limitation of Liability

  • Incidental Damages and Aggregate Liability: TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL JOURNEYFRONT BE LIABLE FOR ANY INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR INDIRECT DAMAGES ARISING OUT OF THE USE OF THE SERVICES. UNDER NO CIRCUMSTANCES WILL JOURNEYFRONT’S AGGREGATE LIABILITY EXCEED THE PRICE PAID BY YOU FOR YOUR ACCOUNT, OR, IF YOU HAVE NOT PAID, THE AMOUNT OF US$25.00. THIS DOES INCLUDE JOURNEYFRONT’S LIABILITY AS AGREED TO IN A SPECIFIC CONTRACTS WITH THE CLIENT.
  • No Liability for non-Journeyfront Actions: TO THE MAXIMUM EXTENT PERMITTED BY LAW, JOURNEYFRONT WILL NOT BE LIABLE FOR ANY DAMAGES WHATSOEVER, WHETHER DIRECT, INDIRECT, GENERAL, SPECIAL, OR CONSEQUENTIAL, ARISING OUT OF OR RELATING TO THE CONDUCT OF YOU OR ANYONE ELSE IN CONNECTION WITH THE USE OF THE SERVICES. IF YOU ARE A CALIFORNIA RESIDENT, YOU WAIVE CALIFORNIA CIVIL CODE SECTION 1542, WHICH SAYS: "A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS WHICH THE CREDITOR DOES NOT KNOW OR SUSPECT TO EXIST IN HIS OR HER FAVOR AT THE TIME OF EXECUTING THE RELEASE AND THAT, IF KNOWN BY HIM OR HER, WOULD HAVE MATERIALLY AFFECTED HIS OR HER SETTLEMENT WITH THE DEBTOR."

10. Indemnification

You agree to indemnify and hold harmless Journeyfront, its officers, directors, and employees from any losses, costs, and expenses (including reasonable attorneys’ fees) arising out of any third-party claim relating to your use of the Services or your violation of this Agreement. Journeyfront reserves the right, at its own cost, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will fully cooperate with Journeyfront in asserting any available defenses.
Clients are solely responsible for ensuring that their job postings, hiring practices, and use of the Services comply with all applicable laws, including but not limited to labor, privacy, and anti-discrimination laws.

11. Communication and Privacy

We may use your email address to send you messages notifying you of important changes to the Journeyfront Services or special offers. If you do not want to receive such email messages please refer to our Privacy Statement to review your options.

12. Term, Termination, and Cancellation

  • Term and Termination: This Agreement will remain in effect until terminated. Either you or Journeyfront may terminate your account at any time by providing written notice. Journeyfront reserves the right to immediately suspend or terminate your access for any breach of this Agreement. We also reserve the right to remove your account information or data from our Services and other records at our sole discretion upon termination.
  • Cancellation Policy: Cancellation terms for Clients are governed by their specific service order with Journeyfont. In the case that the service order does not contain such terms, renewals will be based on the original service term, and cancellation will be available at the time of the Client’s next renewal. 

13. Arbitration

You and Journeyfront agree that any disputes arising out of this Agreement will be subject to FINAL AND BINDING ARBITRATION administered by the American Arbitration Association (AAA). YOU WAIVE THE RIGHT TO GO TO COURT AND THE RIGHT TO PARTICIPATE IN A CLASS ACTION. The only exceptions to this agreement to arbitrate Disputes are claims of infringement or misappropriation of Journeyfront’s copyright, patent, trade secret, trademark, service mark, trade dress or other intellectual property or proprietary rights, which Journeyfront may elect to have resolved by means other than arbitration. Notwithstanding the above, Journeyfront is always interested in attempting to resolve any Disputes by amicable and informal means, and we encourage you to contact us before resorting to arbitration. 

Limitation of Time Period to Commence a Dispute - Regardless of any statute or law to the contrary, and to the maximum extent permitted by applicable law, any Dispute must be filed within one (1) year after the date in which the incident giving rise to the Dispute occurred. Failure to file an arbitration claim as described above within the applicable limitations period constitutes a waiver of such claim and serves as complete bar to any claim based on any Dispute.

14. General Provisions

  • Right to Seek Injunction: Violation of this Agreement may cause Journeyfront irreparable harm. Therefore, you agree that Journeyfront will be entitled to seek injunctive or other equitable relief in court without the necessity of posting a bond.
  • Governing Law: This Agreement shall be governed by the laws of the State of Delaware.
  • Entire Agreement: This Agreement, along with Journeyfront’s Privacy Statement and any applicable service order, constitutes the entire agreement between you and Journeyfront.
  • Failure to Exercise: The failure of Journeyfront to exercise or enforce any right or provision of this Agreement does not constitute a waiver of such right or provision. If any provision of this Agreement is held invalid, the remainder of this Agreement will continue in full force and effect.
